DOL No Longer Has Access to Employer Application Records Beyond Retention Period of Five Years
 
DOL announced that as of October 25, 2013, permanent labor certification applications and supporting documentation are to be treated as temporary records subject to destruction five years after a final determination is made, unless the application is subject to an active investigation or litigation hold and that it no longer has access to labor certifications with a final determination issuance date of five years or older. DOL will not respond to inquiries to confirm priority dates, FOIAs, or requests for duplicate certifications with final determination dates in 2008 or earlier.
